On August 23, 2010, U.S. District Court Judge Jan E. DuBois denied defendants' motion to dismiss the consolidated amended complaint in the nationwide class action, In re Blood Reagents Antitrust Litigation, for which SRKW is acting as sole lead counsel for the plaintiffs. Judge DuBois stated that "the Complaint's charge of a conspiracy between Immucor and Ortho-Clinical is set within a context that renders it plausible." The defendants then urged the Court to reconsider its decision. On December 14, 2010, Judge DuBois denied this request stating that "[a]gainst the backdrop of this evidence of motive and opportunity to collude, the Court concludes, considering the allegations of behavior for which independent self-interested activity is not an 'obvious alternative explanation,' that the Complaint plausibly avers a conspiracy between the defendants in violation of Section 1" of the Sherman Act.
