SRKW A Leader In Case Challenging Effexor Pricing
SRKW has been appointed to lead litigation challenging Wyeth’s and Teva’s efforts to artificially inflate the price of the anti-depressant drug Effexor XR by conspiring to keep generic versions off the market. Based on SRKW’s experience in handling complex class actions, as well as the work it had already performed, Judge Joel Pisano of the U.S. District Court in Trenton, New Jersey appointed SRKW to the Executive Committee of firms leading a nationwide group of end-payor plaintiffs who overpaid for Effexor XR. SRKW has a significant history of successfully prosecuting cases against drug manufacturers that illegally inflate drug prices. The firm’s efforts have recovered over $1 billion for consumers and health plans. SRKW’s efforts are led by Jeffrey Kodroff and John Macoretta.

SRKW Appointed Co-Lead Counsel in In re Life Partners Holdings, Inc. Derivative Litigation
On July 19, 2011, the District Court for the Western District of Texas appointed SRKW to serve as Co-Lead Counsel in the shareholder derivative litigation involving Life Partners Holdings, Inc. The lawsuit alleges members of the company’s board breached their fiduciary duties to Life Partners by engaging in various unlawful business practices, which has caused the SEC to issue a Wells Notice, an indication of a regulatory investigation and a precursor to civil charges.

SRKW Appointed Co-Lead Counsel in In re Synthes, Inc. Shareholder Litigation
On May 27, 2011, the Delaware Court of Chancery appointed SRKW to serve as Co-Lead Counsel in the Synthes shareholder litigation. The class action involves the proposed sale of Synthes to Johnson & Johnson in a transaction valued at approximately $21.3 billion and alleges Synthes’ board breached its fiduciary duties to shareholders by agreeing to a merger that undervalues the company and provides inadequate consideration, and because Synthes’ proxy failed to disclose material information relating to the merger.

SRKW files suit over defective Chevy Impalas
SRKW filed a lawsuit alleging that General Motors breached its warranties on 2007 and 2008 Chevrolet Impalas due to a defective spindle rod (a part in the rear suspension) which causes the tires to be misaligned and wear very prematurely. (more . . .)

SRKW involved in providing over $4 million to charities
SRKW is lead counsel in two cases where significant amounts have recently been awarded to charity. It sometimes happens that a portion of a settlement fund remains after all class members with valid claims are paid. When this happens Courts can, and often do, award such funds to charities under the doctrine of cy pres, on the idea that the funds will be used for a purpose "as close as possible' to the goals of the lawsuit. In two cases where SRKW serves as co-lead counsel amounts of $73,000 and $4 million were recently given to charities suggested by SRKW and approved by the Court. (more . . .)

SRKW partner selected for Fulbright Specialists Program
Partner Ted Lieverman has been selected to participate in the Fulbright Specialists Program sponsored by the U.S. Department of State. He spent three weeks in April lecturing on electoral reform and U.S. constitutional law at the Faculty of Law, University of Belgrade, Serbia. Earlier this year, Lieverman also served as an adjunct professor at the Faculty of Law, Vytautas Magnus University, Kaunas, Lithuania.

SRKW has been named sole Interim Lead Class Counsel, and Jeffrey Corrigan as Liaison Counsel, in In re Blood Reagents Antitrust Litigation, MDL 09-2081 (E.D. Pa.), a nation-wide, price-fixing class action into the market for blood reagents, which are used for testing blood.

Court Allows Wire Tap Claim to Proceed Against Google
In a case of first impression that the court said "presents a novel question of statutory interpretation," U.S. District Judge James Ware upheld plaintiffs' claim that Google's Street View mapping system intentionally collected data transmitted over unencrypted Wi-Fi networks in violation of the federal Wiretap Act. Judge Ware allowed the class lawsuit against Google to proceed.(more . . .)

SRKW's client, the Northern Ireland Local Governmental Officers' Superannuation Committee (NILGOSC), was recently appointed as a co-lead plaintiff in the Lehman Brothers Holdings securities class action pending in the Southern District of New York. SRKW files derivative action in California court on behalf of Genentech, Inc.
SRKW is seeking to maximize shareholder value by instituting a shareholder derivative suit on behalf of Genentech. This suit alleges that when Roche Holding AG, which owns approximately 56% of Genentech, sought to acquire the remaining shares, it did so at an unfair price — in breach of the fiduciary duties it and Genentech’s directors owed to the company’s shareholders.

SRKW Obtains $120 Million in Settlements from OSB Manufacturers
SRKW has negotiated $120 million in settlements of a major antirust case against nine manufacturers of Oriented Strand Board (OSB), a wood-based building material used in most residential construction. SRKW developed and prosecuted this case against the major manufacturers of OSB, who conspired to fix, raise, maintain and stabilize the prices at which OSB was sold in the U.S. This prosecution has now resulted in $120 million in settlements.
